Fire safety issue: HC says enough is enough
A bench of Gujarat High Court has asked the state government and Ahmedabad Municipal Corporation to come out with a concrete action plan over implementation of fire safety measures in schools and hospitals across the state. The court was hearing a petition filed by advocate Amit Panchal that contended that the state government had hardly moved since the court passed orders over the issue of fire safety back in 2001. The plea has also raised the issue of frequent fire outbreaks that claim lives of people. The petition was filed after fire outbreaks, one at Shrey Hospital in Ahmedabad that claimed the lives of eight patients last year and another at Bharuch Covid hospital that claimed the lives of 18 people this year. Several pertinent issues cropped up during the hearing. One was people occupying the buildings despite not having a fire safety NOC and BU permit. The second issue was renewal of fire NOC on yearly basis and the Ahmedabad Fire and Emergency Services (AFES) claiming there was no mechanism to keep track of renewals till now. Several buildings not constructed as per plan and not granted BU permit are still occupied by residents, putting their lives in danger. The court had time and again asked the state and AMC to work out a permanent solution to the issue once buildings were sealed. Pleading helplessness over this issue, Advocate General Kamal Trivedi said if action is taken against all buildings violating norms, then there would be commotion across the state. It is one thing to seal the buildings and another to demolish them and construct them anew, he said, adding it will result in people venting ire at AMC. On this the court asked, “What action has been taken against officers who allowed illegal construction of buildings? You can’t shut your eyes. Officers responsible for such negligence should be taken to task.” When the court reminded lawyers of the state government and AMC about its orders six months ago and asked what progress had been made in taking action against violators, they sought time of four weeks to furnish details. While granting time to the government, the court said, “Enough is enough and it is time to take action. Whatever action is necessary, you have four weeks to do it.” AFES affidavit in court In an affidavit filed with the Gujarat High Court, AMC had said that almost 45 per cent of the buildings in the city including residential, commercial, schools and hospital complexes do not have fire No Objection Certificate (NOC). There are a total 10,329 buildings in Ahmedabad under various categories including schools and hospitals. Out of these, 5,444 have the valid fire NOC while the rest 4,784 buildings don’t have the mandatory certificate. In the residential category, 1,876 out of 3165 high rise buildings don’t have the fire NOC as of June 1. For residential-cum-commercial category, 663 out of 1,344 buildings don’t have it. Among educational institutes, about 850 schools are operating without fire NOC in Ahmedabad. As of June 1, 374 out of 1,852 hospitals were without fire NOC. Among malls and multiplexes, 37 out of 86 don’t possess the certificate. Out of 189 petrol pumps, 38 are on the list not complying with norms. AFES has clarified before the court that the number of high-rise buildings not having NOC have increased post the introduction of Record Management System (RMS) and physical verification of the buildings. ...
